For the purposes of these T&C’s:
- “Us”, “Our”, and “We” refers to Full Circle Industries Pty Ltd.
- “You”, “Your”, “Purchaser,” “Customers”, and “Customer” refers to you, our valued customer.
- “Products” refers to all products sold by Full Circle Industries Pty Ltd, which may change from time to time.
- “Services” refers to all services sold by Full Circle Industries Pty Ltd, which may change from time to time.
- “Third-Party Suppliers” refers to A third-party supplier is an external entity or business that provides goods, products, services, or information to Full Circle Industries Pty Ltd or directly to our customers, but is not directly affiliated with or part of Full Circle Industries Pty Ltd.
- “Transport Partners” refers to an external entity or business that provides a delivery service on behalf of Full Circle Industries Pty Ltd, but is not directly affiliated with or part of Full Circle Industries Pty Ltd.
- All dollar amounts are in Australian Dollars and include GST
Amendment of Terms
We reserve the right to modify, add, change or delete/remove any part of these T&C’s at any time. Upon accepting these T&C’s by payment or signature, the Customer agrees that these terms govern our rights and obligations and subsequently their rights and obligations.
Installation Warranty
1. Warranty Coverage:
Full Circle Industries Pty Ltd warrants that all installation services performed will be completed in accordance with industry standards and in a workmanlike manner. This warranty covers only defects or issues directly resulting from improper installation or errors made during the installation process.
Full Circle Industries Pty Ltd warrants products they have supplied and used in relation to the installation process. We do not warranty any parts supplied with the Customer’s purchase that arrive damaged or are incorrectly supplied. Full Circle Industries Pty Ltd, will to the best of their ability, rectify the damaged part/s so installation can occur, however no warranty is offered on these parts and work.
FCI do not provide a warranty for any areas sealed by the manufacturer or by a third party. If any manufacturer-sealed areas are found to be below standard, we may remove the original factory seal and apply an appropriate replacement sealer. Once replaced, the new sealer will be covered in accordance with the manufacturer’s guidelines.
2. Duration of Warranty:
This installation warranty is valid for 12 months from the date of completed installation.
3. Warranty Claims:
In the event of a defect or issue related to the installation, the customer must notify Full Circle Industries Pty Ltd in writing within 7 days from the discovery of the issue. No warranty claims will be accepted if the issue is not reported immediately and the issue has persisted for an extended period of time. Full Circle Industries Pty Ltd will, at their discretion, either repair or re-install the product/service at no additional cost to the customer.
4. Exclusions:
This installation warranty does not cover:
- Damages caused by the customer’s misuse or neglect of the installed product.
- Issues arising from pre-existing conditions or external factors beyond the control of Full Circle Industries Pty Ltd (e.g., electrical faults, extreme environmental factors, flooding, fire, misuse, damage from accidents, as well as hail and/or storms).
- Any modifications or alterations made to the installation after completion.
5. Limitations of Liability:
Full Circle Industries Pty Ltd liability under this installation warranty is limited to the cost of repairing or reinstalling the product or service. In no event shall Full Circle Industries Pty Ltd be liable for any indirect, incidental, or consequential damages.
6. Transferability:
This warranty is non-transferable and applies only to the original customer who purchased the installation service.
Product Installation and Responsibility
- The Purchaser is solely responsible for bearing all costs relating to council permits or approvals.
- Full Circle Industries Pty Ltd is not liable for any additional costs relating to ensuring that the installation complies with all relevant laws or regulations, and you indemnify us against any related claims or losses with respect to ongoing product compliance.
General T&C’s
Acceptance
A full or partial payment made to Full Circle Industries Pty Ltd in relation to an invoice provided to you by us is deemed as your full confirmation that you understand and agree to all details stated on the invoice, including but not limited to the purchased items, item prices, delivery notes and payment terms and that you have read, understood and confirm your full acceptance of these T&C’s.
Purchaser Cancellations and Variations
If an order containing products in our standard product range is cancelled after a deposit payment is received by us, the total deposit value shall be forfeited if the order is cancelled.
Refunds and Returns
Under Australian Consumer Law (ACL), a customer is eligible for a refund, repair or replacement if a service fails to meet one or more of the following consumer guarantees.
Major Problems with Goods or Service
A major problem means the product:
- is unsafe
- is very different from the description or sample
- has a serious problem or several smaller problems making the product unsellable or at the very least would need to be sold at a reduced price.
- can’t be used for its normal purpose, or another purpose the consumer told the seller about before they bought it, and can’t easily be fixed within a reasonable time.
A customer can request a refund or replacement of the same type of product.
Minor Problems
If a product has a minor fault, the business must fix the problem or repair the product for free.
Note: the business does not have to offer a replacement or refund unless the business cannot fix the issue in a reasonable timeframe.
Non-refundable Conditions
Consumers are not entitled to a repair, replacement or refund under the consumer guarantees if:
- they got what they asked for but simply changed their mind, found the product cheaper somewhere else, or decided they didn’t like the purchase or had no use for it. However, if a business has a ‘change of mind’ policy, they must follow it.
- the problem with the product was caused by the consumer misusing it
- they knew of or were made aware of the problem with the product before they bought it (but they may be entitled to a repair, replacement or refund for a different problem with the product that wasn’t made clear to them before they bought it)
- asked for a service to be done in a certain way against the advice of the business
- the problem with a service was caused by the actions of someone other than the business
Financial hardship
If a customer faces financial difficulty and is unable to fulfill their contractual obligations, we strongly encourage them to reach out to us as soon as possible to discuss alternative payment options.
Notes:
- In line with Australian Consumer Law, if goods or services have been provided as agreed and are neither faulty nor misrepresented, there is no automatic right to cancel the agreement or receive a refund due to changes in circumstances or financial hardship.
- Any payments made prior to renegotiating or adjusting the payment terms may be retained by the business as part of the original contract.
Adjusting the payment terms does not impact your rights under Australian Consumer Law, including any relevant consumer guarantees.
Council Regulations and Refunds
Customers are responsible for ensuring that any required planning approvals, zoning permissions, or council consents are obtained before purchasing and placing a tiny home on their land. The business has no obligation to offer a refund where:
- The customer fails to obtain necessary council approval
- The local authority prohibits placement of the tiny home on the intended property; or
- The customer did not undertake due diligence regarding planning or development restrictions.
Refund Conditions
If a customer requests a refund after the delivery of a product, Full Circle Industries Pty Ltd reserves the right to approve or deny the return at its sole discretion. If Full Circle Industries Pty Ltd approves the return, the Purchaser agrees to the following terms:
- The Purchaser is responsible for any costs associated with returning the product.
- All returns are subject to inspection once the product is physically returned to Full Circle Industries Pty Ltd.
- Returns for refunds may be rejected if the product is not in the same condition as when it was delivered to the customer, and the product will be sent back to the customer.
- By accepting these Terms & Conditions, the Purchaser agrees to cover any costs related to the inspection and return of products that are not in their original condition upon return.
General T&C’s
By accepting these T&C’s, the Purchaser agrees that:
- The Purchaser is solely responsible for checking all relevant laws, local council guidelines, and State legislation to ensure compliance with the use and occupancy of our products on your property or any other location where you may place the product.
- Full Circle Industries Pty Ltd shall not be held responsible for any penalties imposed on the Purchaser by council, government, or any other agencies.
- Costs incurred by Full Circle Industries Pty Ltd due to incorrect or inadequate information provided by you may result in additional charges for which you will be liable.
- From time to time, we may provide links, advertisements, and information about other businesses for your convenience. This does not imply any sponsorship, endorsement, approval, or agreement between us and those businesses. We are not responsible for the actions or advice of any third-party suppliers.
- Any variations to these T&C’s for your order must be mutually agreed upon in writing by Full Circle Industries Pty Ltd and the Purchaser.
- In the event that circumstances beyond our control (Force Majeure Events) obstruct or prevent the delivery of products to you, Full Circle Industries Pty Ltd will be relieved of any obligation to provide the products as long as such circumstances persist.
- While Force Majeure Events persist, Full Circle Industries Pty Ltd may, at our sole discretion, either terminate your order with us or keep your order with us in suspension until the circumstances have ended.
- Force Majeure Events include but are not limited to illness, unavailability of materials, pandemics, strikes, natural disasters, fires, war, acts of God, government orders, transport difficulties, and technology failures.
- All quotes supplied by Full Circle Industries Pty Ltd are valid for the time period listed on the quote.
- All marketing material supplied by Full Circle Industries Pty Ltd must be used as a guide only.
Limitation of Liability
By using our products or services, you agree that Full Circle Industries Pty Ltd is not responsible for any direct, indirect, consequential, or incidental damages that may arise from your purchase or use of our products. This includes, but is not limited to, loss of usage, revenue, time, or damage to personal property.
Any reliance on information or materials provided by Full Circle Industries Pty Ltd is done at your own risk. We are not liable for any issues that may result from such reliance. It is your responsibility to ensure that the products or services you purchase from us are suitable for your specific needs.
While any advice, recommendations, or assistance we provide is offered in good faith and believed to be accurate and reliable at the time, we do not guarantee the accuracy, suitability, or dependability of this information. We assume no liability for any loss or damages resulting from your reliance on these services or advice.
By purchasing from us, you agree to indemnify Full Circle Industries Pty Ltd against any claims beyond those covered by the guarantees mandated by Australian Consumer Law.
Indemnity
By agreeing to these T&C’s, you commit to absolve us, our employees, and agents from any claims, demands, or legal actions, whether initiated by yourself or others, against us or for which we bear liability. This indemnification covers losses related to:
- Product supply.
- The subject matter of these T&C’s.
This encompasses, without limitation, any legal costs we incur to address claims or demands, as well as any party-party legal costs for which we are liable concerning such claims or demands.
You acknowledge that beyond these T&C’s, we provide no warranty, assurance, promise, or representation regarding product quality, fitness for purpose or use, suitability, or merchantability for any specific purpose. By entering into these T&C’s, you have relied exclusively on your own inquiries, knowledge, skill, and judgment.
Intellectual Property
By accepting these T&C’s, the Purchaser explicitly acknowledges and agrees that Full Circle Industries Pty Ltd is the sole and exclusive owner of all intellectual property related to its products. This includes, but is not limited to, trademarks, patents, copyrights, designs, technical information, processes, and confidential information associated with the products. It also covers advertising, promotional materials, technical content, and user manuals or videos linked to the production or supply of the products. This definition applies to all items that can be legally protected, regardless of whether formal protection has been obtained.
Furthermore, by agreeing to these Terms and Conditions, the Purchaser confirms that they will not acquire any intellectual property rights over the products through their transactions or purchases. The Purchaser agrees not to challenge or dispute Full Circle Industries Pty Ltd’s ownership of the intellectual property. The Purchaser also commits to refraining from infringing on these rights, promptly notifying the company of any suspected or actual infringement, and following any reasonable instructions or requests from Full Circle Industries Pty Ltd regarding the protection of its intellectual property.
Jurisdiction
This agreement is subject to the laws of Queensland, Australia. If there is a dispute between you and Full Circle Industries Pty Ltd that results in litigation, then you must submit to the jurisdiction of the courts of Queensland.
Exclusion of Unenforceable Terms
In the event that any clause or term stated above would, by the provisions of any applicable statute, be deemed illegal, void, or unenforceable in any State or Territory, then such a clause shall not be applicable in that State or Territory. It shall be deemed to have never been included in these T&C’s for that specific State or Territory. However, if such a clause is legal and enforceable in any other State or Territory, it shall remain fully enforceable and constitute a part of this agreement in those other States and Territories. The deemed exclusion of any term pursuant to this paragraph shall not affect or modify the full enforceability and construction of the other clauses in these T&C’s.
Title
The risk in and title to the products supplied by Full Circle Industries Pty Ltd will transfer to the Purchaser upon the delivery of the products to your designated address or upon completed loading of your order onto your designated transport provider. The Purchaser will only gain ownership title of the products after paying all outstanding amounts owed to Full Circle Industries Pty Ltd.
No Waiver of Rights
The failure or delay of a party to exercise a power or right in respect to these T&C’s does not constitute a waiver of that power or right.
